Hastings District Council : Tangata Whenua Wastewater Joint Committee  Terms of Reference

 

This is established between Hastings District Council and representation of Tangata Whenua.

Fields of Activity

To be actively involved in developing the Hastings District Council’s wastewater treatment and disposal system policies, receiving, reviewing and recommending action on reports concerning the operation and performance of the Council’s wastewater disposal system and ocean discharge including alternative treatment and disposal options, and, in particular, providing advice in regard to the Trends, Technology, Discharge, Environmental and Monitoring Nine Yearly Review, in accordance with the Resource Management Act 1991 and Policies and Plans under the Act, and in particular, to recognise the role of Tangata Whenua as kaitiaki, and, to satisfy their cultural concerns.

         

To receive, review and recommend action on wastewater reports.

 

To recommend the commissioning of reports and future Hastings District Council actions on wastewater issues including:

 

·         Options for further treatments

·         Options for methods of disposal

·         Monitoring effects on the environment

 

To coordinate and oversee education of the community on wastewater issues.

 

Membership

Chairman appointed annually by the Joint Committee from its members annually to alternate between the Council and Tangata Whenua representatives.

5 Councillors and 5 Tangata Whenua representatives, appointed by the Council

 

Quorum – 6 members including not less than 3 Councillor representatives.

The Democratic Support Manager, Mrs Evans called for nominations and as per the Terms of Reference, the Chair was to be selected from the elected members for this term.

 

 

Councillor Watkins nominated Councillor Heaps, with no other nominations put forward.

A)        That the report of the Democratic Support Manager titled Election of Chairman to the HDC-Tangata Whenua Wastewater Joint Committee dated 1/03/2018 be received.

Following discussion in regard to the necessity of appointing a Deputy Chairperson, the meeting agreed that the Terms of Reference remain status quo and that no Deputy Chairperson be elected.

 

 

 

5.

HDC-Tangata Whenua Wastewater Committee Background

(Document 18/34)

 

 

The Water Services Manager, Mr Chapman advised that it was important to reflect on the role of the Committee, which was a Committee of Council and referenced in the current Wastewater Consent.  The conditions of the consent required that Council has a Wastewater Committee to provide advice and ensure that the conditions were met both on an annual basis and at the nine yearly review.

 

The Wastewater Manager, Mr James advised that the role and capacity of the Committee was to provide advice to Council around the wastewater treatment.  Consent 29 provided the requirement for the HDC-Tangata Whenua Wastewater Joint Committee. 

 

A nine yearly review was a condition of the consent to review the treatment process, technology, growth patterns and community. Officers were beginning to plan for the nine yearly review and at this point the input and perspective from this Committee became valuable.   Council had been operating under new the consent conditions for last 3.5 years.

 

Past members of the Committee also provided a brief history on the journey of the Committee.  At this point Mr von Dadelszen suggested that a compilation of an accurate record of this journey be written and that the history that could be accessed via the website and/or displayed at the East Clive Wastewater Treatment Plan.

 

Mr Russell advised that Stantec would be supportive in assisting with the compilation of recording the history.

Annual Report

(Document 18/46)

 

 

The Wastewater Manager, Mr James advised that the purpose of the report was to present the Annual Wastewater Resource Compliance Report and provide an update on key wastewater activities.  A requirement of the new consent was the preparation of an Annual Compliance Report.  The purpose of Annual Compliance Report was to assess compliance with the conditions of the resource consent (CD130214W).

 

 

The Wastewater Treatment Manager, Mr McWilliams displayed a powerpoint presentation (CG-14-15-00004) highlighting the following points:

·         The Current Discharge consent requires an annual inspection, which costs approximately $3000.00 per annum.

·         The consent for the installation of the new diffuser requires an inspection of the old diffuser to ensure it remains in place.

·         Looking to use side scan sonar to initially plot the position of the old diffuser which will become the reference point.

·         The new diffuser would also be scanned in order to be able to identify any movement.

·         A scan of the outfall pipeline would be undertaken looking for leaks or debris that may foul the pipeline.

 

Mr James also advised that there was provision under the Resource Management Act to review the consent document.  Officers were currently working through some minor consent condition revisions with the Hawke’s Bay Regional Council.

 

It was also proposed that the toxicity testing be changed to annual testing from quarterly testing.  The testing was very expensive at $10,000 per test.

 

In regard to the new Health and Safety Act a tour of the Wastewater Treatment Plant  had been organised for elected members to visit the facility on 20 March 2018.  Mr James advised that if members wished to have a more informed visit of the facility this could be arranged.

SUBJECT:                    Going Forward - Tangata Whenua Wastewater Joint Committee        

 

 

1.0       SUMMARY

1.1       The purpose of this report is to seek guidance from the Committee on issues that:

a)   relate to the appointment of Tangata Whenua representatives to the Council Committee that is required to be established and maintained under the provisions of condition 29 of the District Council’s Wastewater Discharge Consent granted on 25 June 2014.

1.2       The Council is required to give effect to the purpose of local government as prescribed by Section 10 of the Local Government Act 2002. That purpose is to enable democratic local decision-making and action by, and on behalf of, communities

1.3       While this decision is principally administrative and relates to Council’s governance and decision-making arrangements in carrying out the purpose of local government, in particular this decision addresses the intent to maintain and improve opportunities for Māori to contribute to local government decision-making processes, and to facilitate participation by Māori in local authority decision-making processes.

1.4       This report concludes by recommending that the Committee accept the report.

2.0       BACKGROUND

2.1       The Hastings District Council established a Committee known as the HDC: Tangata Whenua Wastewater Joint Committee on 14 August 2000. The Committee has its Terms of Reference and explicit purpose (Attachment 1) and is intended to assist the Council to address and recognise the role of Tangata Whenua as kaitiaki and to address cultural concerns that may be held by Tangata Whenua, particularly in respect to human waste in the waste stream.

2.2       The establishment and maintenance of that Committee was seen as critical to ensuring that an appropriate treatment process was established and able to be developed. The Committee included five Council representatives and five Tangata Whenua representatives; three representatives were to be nominated by the Heretaunga Māori executive and two representatives nominated by the Ahuriri Māori executive.

2.3       The Committee has lost two tangata whenua members who have passed on in recent years but they have not been replaced as yet, meaning the Committee is down two of its six tangata whenua members. Tipu Tareha passed away in 2013 and Gordon Paku passed away in 2018.

2.4       The Council’s wastewater discharge consent included a requirement to maintain the Committee and the Terms of Reference to reflect the requirements of that consent.

2.5       As set out above the Tangata Whenua representatives were to be nominated by two Māori Executives. These organisations were created under the auspices of the New Zealand Māori Council. The New Zealand Māori Council has recently changed its structural approach such that the foregoing mentioned executives no longer exist.

2.6       The history leading up to formation of the HDC: Tangata Whenua Wastewater Joint Committee goes back a long way to the 1990s when Council first made an application to continue with the milli-screen discharge. Tangata Whenua and members of the community opposed this approach and this led to a reconsideration of the future way forward.

2.7       An important part of the reconsiderations was the journey of discovery Council and Tangata Whenua representatives embarked upon to find a new wastewater treatment approach. This journey included a ‘hīkoi’ that looked at a number of treatment and disposal systems in New Zealand as well as in England and Spain.

2.8       The outcome of this journey was the genesis of the Biological Trickling Filter (BTF) treatment process including the design and construction of the Rokahori rock passage as part of the treatment process.

2.9       The Joint Committee journey has been long and successful and an opportunity for senior members of the Committee to share their wisdom and perspective with us is now invited. 

3.0       CURRENT SITUATION

3.1       The 2014 consent embodies new conditions related to a Committee similar to that which previously existed. Condition 29 of the new consent provides for the Council to establish and maintain a Committee that has a range of functions that are not dissimilar to the existing requirements but are different and require the Council to adopt new terms of reference.

3.2       The consent requires Tangata Whenua representatives where there are some caveats around the representatives in particular.

3.3       The consent (condition 29) explicitly refers to the principles of the Treaty of Waitangi (especially those of partnership and consultation) and recognising the role of Tangata Whenua as kaitiaki. This implies a need to ensure that the selection of those representatives also has alignment with the principles of partnership and consultation and the role as kaitiaki.

3.4       The implication is that selection of the representatives requires some consultation and potentially nomination of those representatives to the Committee. It is also implied that there is a need to consider who rightfully fulfils the role as kaitiaki, which suggests that those who exercise that role have mana whenua status.

3.5       The New Zealand Māori Council structure has changed and its “local” representative body is more regional by nature and is constituted as the Takitimu District Māori Council.

4.0       MOVING FORWARD

4.1       Further to the national and regional 3Waters Review projects, the Māori Joint Committee will have the opportunity to voice and shape future and extensive kaitiakitanga, including the scope of this Committee with regards to 3Waters. The following points should be part of this discussion:

·   There has been some discussion of late and dating back as far as the early 2000s as to broadening the scope to include consideration of matters relative to what is known as the “three waters” - stormwater, water supply and wastewater.

·   If there is still a desire or indeed a necessity to extend the scope then it will need to be carefully considered and the nature of representation may well be slightly different to that which might be expected to meet the conditions of the resource consent wastewater treatment and disposal.

·   One suggestion has been that the “three waters” approach is more appropriate at a regional level than a District Council level. Early resolution of this question is necessary to enable progress on the establishment of the committee required by condition 29.

·   A couple of questions though remain and so, one) what is the scope of kaitiaki that is being exercised? And two) is the scope distinctly related to the receiving waters or is it a broader scope that more closely reflects a Maori World view that includes the land and water?

·   Determining appropriate responses to these questions will assist in understanding who exercises the appropriate kaitiaki and thus provides a signpost is to how the representation might be identified.

5.0       SUMMARY

5.1      The fundamental guidance to be sought regarding appointments to fill the two vacant roles on the Tangata Whenua Wastewater Committee centres on:

·    Who do we (Council) consult with to obtain appropriate nominations of representatives?

6.0       SIGNIFICANCE AND ENGAGEMENT

6.1       This matter is likely to be of some public interest, however seeking any further community views at this juncture is not considered necessary and this matter can be determined following further guidance and advice from this Committee.

 

 

7.0       RECOMMENDATIONS AND REASONS

A)        That the report of the Wastewater Manager titled Going Forward - Tangata Whenua Wastewater Joint Committee dated 28/06/2019 be received.

B)        That the Committee recommend to Council a process to appoint Tangata Whenua members to the HDC : Tangata Whenua Wastewater Joint Committee to fulfil the provisions of Condition 29 of the District Council’s Wastewater Discharge Consent granted on 25 June 2014.

1.0       SUMMARY

1.1       The purpose of this report is to present the Annual Wastewater Resource Consent Compliance Report to the Committee and update the Committee on key wastewater activities.

1.2       This report has been prepared as a result of the ongoing operation of Council’s wastewater system and the need to comply with consenting requirements under the Resource Management Act 1991.

1.3       The Council is required to give effect to the purpose of local government as set out in section 10 of the Local Government Act 2002. That purpose is to enable democratic local decision-making and action by (and on behalf of) communities, and to promote the social, economic, environmental, and cultural well-being of communities in the present and for the future.

1.4       The purpose of this report is relevant to the provision of good quality wastewater infrastructure that is efficient, effective and appropriate to present and future circumstances.

1.5       The report concludes that overall the current treatment and discharge through the long offshore ocean outfall is compliant with resources consent conditions and provides for an environmentally and culturally acceptable, sustainable and economic solution for wastewater treatment from the Hastings District Council and recommends that the Committee receive the report.

2.0       BACKGROUND

2.1       In June 2014 Hastings District Council (HDC) was granted a new 35 year long-term consent for the discharge of treated wastewater from the plant at East Clive, through a long ocean outfall into Hawke Bay.

2.2       The discharge consent expires on 31 May 2049 and the wastewater system has been operating under the new consent for five years. 

3.0       2017/18 ANNUAL COMPLIANCE REPORT

3.1       In accordance with the consent conditions the Annual Compliance Report was completed, peer reviewed and submitted to the Hawkes Bay Regional Council within prescribed timeframes.

 

 

Consent Performance Overview

3.2       The Domestic and Non Separable Industrial (DNSI) treatment system’s Biological Trickling Filter (BTF) is operating within the prescribed quality parameters of the consent.

3.3       The DNSI treatment and contaminant concentration levels were consistently reduced by the treatment system to levels within the consent limits. There was some variation in treatment performance based on seasonal influent flows and loads. On an annual level there was on average 48.85% reduction in suspended solids, 50.8% reduction in total oil and grease and 81.9% reduction in cBOD5.    

3.4       The Final Combined Discharge complies with all the contaminant levels required by the consent. Again some variation based on seasonal influent flows and loads was observed.  There was also no evidence to suggest increasing toxicity levels. The final combined discharge tends are in keeping with previous year’s results and trends. 

3.5       The sediment analyses show some differences between sample sites within the mixing zone.  Overall the sediments comply the ANZECC 2000 sediment quality guidelines.

3.6       A minor non-compliance has been highlighted against Condition 17.  This was due to the drogue failure to collect data for the 4th Quarter.  The failure to collect data in the 4th Quarter has no material impact on our assessment and monitoring of long term effects in the receiving environment.

3.7       The report concludes that overall the current treatment and discharge through the long offshore ocean outfall is compliant with resources consent conditions and provides for an environmentally and culturally acceptable, sustainable and economic solution for wastewater treatment from the Hastings District Council.

Condition 5 states that “The final combined wastewater discharged shall meet prescribed screening and filtering requirements. Annual average daily loading of the cBOD5 of 0.4 kg per m3 of media

 

 

 Annual average daily cBOD5 loading rate = 0.23 Kg/m3. The maximum daily cBOD5 loading rate = 0.353 Kg/m3. E10

Condition 6 states that “The final combined wastewater discharged shall meet the prescribed standards

 

 

The Hills Laboratory sampling results were input into spreadsheet and analysed for the maximum concentrations of the various constituents in Condition 6.  Condition 6 was complied with during the 1 July 2017 to 30 June 2018 reporting period.

Condition 7 states that “The discharge of the final combined wastewater as authorised by this Resource Consent shall not cause any of the prescribed effects beyond a distance of 750m from the midpoint of the outfall diffuser

 

 

No abnormalities in the colour, clarity, grease films, scums and floatable material or undesirable biological growths were monitored and reported in the period under review.

Condition 8 states that “The average concentration of Total Oil and Grease in the final combined wastewater shall not exceed 200g/m3   over any 24 hour period based on the sampling procedure   set  out  in Conditions 13 and 14

 

 

The Hills Laboratory results for oil and grease concentrations indicated that Condition 8 was complied with during the 1 July 2017 to 30 June 2018

Condition 9 states that “The Consent Holder shall inspect the diffuser at least annually and at intervals not more than 14 months apart….

 

 

The inspection was carried out on 24 July 2018

Condition 10 states that “The Consent Holder shall ensure that all components of the wastewater treatment plant and outfall structures are maintained in good working order, and in accordance with industry best practice guidelines

 

 

Routine preventative maintenance of the plant and equipment is undertaken on a regular basis and records logged into Council’s asset data systems (IPS and Infrastructure Data). Reactive maintenance is undertaken in response to unplanned events. The plant is operated by 3 FTEs and specialised electrical and mechanical expertise is provided by contractors.

Condition 11 states that The Consent Holder shall ensure that all sampling equipment, including meters and field measurement devices are maintained in good working order by suitably qualified persons …

 

 

All equipment is calibrated to recognised standards and is kept in good working order by qualified technical staff. Therefore, Condition 11 was complied with during the period under review.

Condition 12 states that The Consent Holder shall continuously monitor and record the rate of discharge and the daily volume of the final combined wastewater is charged. 

 

 

The flow meters used for recording the discharge are maintained as per the manufacturers guidelines as highlighted in Section 4.10.1. Therefore, Condition 12 was complied with during the period under review.

Condition 14 states that Starting 12 months from the date of commencement of this consent, at quarterly intervals, with not less than 2 months between each sample, the Consent Holder shall take 24-hour flow proportional samples on a minimum of 7 consecutive days of the  waste streams, and analyse them for the prescribed constituents

 

 

Condition 14 was complied with during the period under review

Condition 15 states that At quarterly intervals, with not less than 2 months between each sample, the Consent Holder shall test the toxicity of the final combined wastewater

 

 

The Adaptive Management Plan provides a decision tree to assist in deciding the risk to the environment based on various criteria.  There were two results in excess of 1 in 200.  Based on the decision tree no further action was required on any sample.

Condition 16 states that At quarterly intervals, with not less than 2 months between each sample, the Consent Holder shall take water quality samples at 10 sites perpendicular to the centre of the diffuser …

 

 

Condition 16 was complied with during the period under review.

Condition 17 states that While samples are being taken in accordance with Condition 16, a GPS drogue shall be placed at the centre of the diffuser to measure the surface currents for at least 30 minutes”

 

 

There is no drogue data for the 4th Quarter as the equipment malfunctioned during the sampling. This resulted in a minor non-compliance. Given the type of location data collected by the drogue, the failure to collect this data in the 4th Quarter has no bearing on the environmental effects.

Condition 19 states that Twice during the year (summer and winter) the Consent Holder shall take seabed sediment grab samples

 

 

Condition 19 was complied with during the period under review as the sampling data required by the condition was collected

Condition 20 states that “All quality analysis of the wastewater discharged other than field measurements as required by the conditions of this consent shall be undertaken by an independent laboratory accredited to IANZ

 

 

Analyses carried out by Hill Laboratories (IANZ accredited) and NIWA Toxicology Laboratory. Condition 20 was complied with during the period under review

Condition 24 states that Before 1 October each year, the Consent Holder shall provide the Regional Council (manager Resource Use) with an “Annual Monitoring Report”,

 

 

This report has been prepared in compliance with Consent Condition 24.

Sub conditions 24 a-d were complied with during the period under review.

Condition 25 states that Each Annual Monitoring Report shall be made publicly available on the Consent Holder's website within one month of it being lodged with the Regional Council

 

 

The 2016/2017 Annual Report was not included in a ratepayer newsletter, but notification was placed on the Council website, in the newspaper and radio advertisements

Condition 26 states that During the month of November each year, the Consent Holder shall have a public 'open day' at the Wastewater Treatment Plant site…

 

 

The Open Day was held on 27/11/2017

Condition 28 states that The Consent Holder shall log all complaints received relating to the discharge

 

 

There were no odour complaints in relation to this consent during the period under review

Condition 30 states that In the event of the Consent Holder becoming aware unusual or extreme circumstances that may lead to one or more conditions being breached….

 

 

Other than the malfunction of the drogue during the 4th Quarter sampling, there were no issues that caused non-compliances during the period under review.

 

4.0       ANNUAL WASTEWATER PLANT OPEN DAY

4.1       The annual Open Day was held on Saturday the 24 November 2018. The open day was well attended and a lot of interest and positive feedback was received from those who attended.

5.0       CONSENT CONDITIONS REVIEW

5.1       The Council has an opportunity under section 127 of the RMA to instigate revisions of consent documentation.

5.2       There are a number of minor consent condition revisions that we are discussing with HBRC. The revisions focus on improvements to the conditions based on the past 5 year’s operations under the new consent.

6.0       NINE YEARLY CONSENT REVIEW

6.1       Condition 27 of the long term 35 discharge consent requires Council to undertake a Nine Yearly Review. Investigations and studies are likely to commence in 2021/22.

6.2       The review process will involve Council staff, the TWWJC and technical experts and will requires us to consider the following:

·    Population and industry trends assessment

·    Wastewater flows and loads trends assessment

·    Trade waste profile assessment

·    Assessment of environmental guidelines and standards for treated wastewater

·    Assessment of operational aspects and changes in wastewater treatment technology and potential opportunities for beneficial reuse.

·    Undertake benthic review, hydrodynamic study and public health impacts assessments

7.0       TREATMENT PLANT OPERATIONS UPDATE

7.1       The wastewater treatment plant continues to operate within its consent and performance parameters. Plant staff are closely monitoring and investigating BTF operations as higher than expected water levels have been observed in certain fan ducts during periods of high rainfall. There is currently no impact on BTF performance. Further information will be reported when monitoring and investigations activities have been completed.

7.2       A number of condition assessments are underway at the plant these investigations will help develop more comprehensive planned or preventative maintenance and renewals programmes. These programmes will feed into the 2021 LTP process.

7.3       Apart from the routine maintenance activities the following works are underway at the wastewater plant:

·    Replacement of the dewatering system in the Milliscreen building.

·    Replacement of one of the domestic step screens with a Centre-Flo band screen.

·    Upgrade of the plant control system (PLC).

·    Outfall pump station manifold renewal planning.

·    Emergency beach overflow chamber renewal

8.0       TRADE WASTE UPDATE

8.1       The trade waste management processes under the Council Consolidated Bylaw is running well. Council’s Trade Waste Officer and the trade waste industries continue to work together to ensure Trade Waste Approval compliance is maintained at High levels.

 

9.0       RECOMMENDATIONS AND REASONS

A)        That the report of the Wastewater Manager titled 2017/18 Annual Wastewater Treatment Resource Consent Compliance Report dated 28/06/2019 be received.

With the reasons for this decision being that the objective of the decision will contribute to meeting the current and future needs of communities for good quality local infrastructure.
