The Road Closure Subcommittee is responsible for assisting Council by:
· Reviewing, considering submissions and deciding applications for temporary closure of roads.

DELEGATED POWERS
All the Council’s powers and functions in respect to temporary prohibition of traffic under Section 342(1)(b) and clause 11(e) of Schedule 10 of the Local Government Act 1974.

1.0 SUMMARY
1.1 The purpose of this report is to obtain a decision from the Committee on the following temporary road closures requested by Club Targa Incorporated for the Targa Rally to be held on18 to 20 May 2018.

1.2 This request arises from the need to inform and gain Hastings District Council (‘the Council’) approval in order to comply with the legal process to temporarily closing the above roads.
1.3 The Council is required to give effect to the purpose of local government as prescribed by Section 10 of the Local Government Act 2002. That purpose is to meet the current and future needs of communities for good quality local infrastructure, local public services, and performance of regulatory functions in a way that is most cost–effective for households and businesses. Good quality means infrastructure, services and performance that are efficient and effective and appropriate to present and anticipated future circumstances.
1.4 The objective of this decision relevant to the purpose of Local Government is to provide for good quality local public services by allowing the proposed events to take place in a controlled environment with the temporary road closure provisions providing safety measures for residents and road users in the particular areas while the activities are being undertaken.
2.0 BACKGROUND
2.1 Club Targa Incorporated has traditionally held the Targa Rally every one or two years within the Hastings District. Submissions were received during the 2013 temporary road closure application process which resulted in the Temporary Road Closure Subcommittee giving thought to only allowing roads to be closed for the rally on a three yearly basis.
2.2 The following is the resolution that was included as a condition (under Condition “D”) in the consent granted by the Temporary Road Closures Subcommittee at its meeting on 5 September 2013:
“That, in consideration of the concerns raised by submitters, the Targa Rally organisers be invited to meet with Hastings District Council officers, within three months of the closure of the 2013 rally, to discuss a strategy for future road closures and possible routes with a view to not closing the district’s roads for Targa rallies more than once every three years.”
3.0 CURRENT SITUATION
3.1 The above event is being held by the following organisation: Ultimate Rally Group which Club Targa Incorporated is part of, on selected Hastings District rural roads. This is the first temporary closure of the above roads during this calendar year.
3.2 Attached, as Attachment 1, in Appendix A, is the Temporary Road Closure check list detailing the necessary items that the organiser needs to submit as part of their application for the above proposed road closures. GIS maps showing the area of the temporary road closures are also attached as: Attachments 2, 3, 4, 5, 6, 7, 8, 9 and 10: Taihape Road, Ohiti Road, Matapiro Road, Crownthorpe Settlement Road, Apley Road, Puketitiri Road, Glengarry Road, Tuki Tuki Road, Kahuranaki Road, Middle Road, Okaihau Road, Maraetotara Road, Raukawa Road, Whakapirau Road and Te Aute Road.
3.3 The temporary road closures will be managed in accordance with the New Zealand Transport Agency Code of Practice Temporary Traffic Management (CoPTTM).
3.4 A detailed Traffic Management Plan is to be submitted to the Hastings District Council and the Plan will be approved for implementation subject to the temporary road closure application being approved.
4.0 OPTIONS
4.1 Option A: Approve the temporary road closures detailed above.
4.2 Option B: Do not approve the temporary road closures detailed above.
4.3 Option C: Approve only some of the temporary road closure detailed above.
5.0 SIGNIFICANCE AND ENGAGEMENT
5.1 Club Targa Incorporated representatives undertook a resident consultation process. If residents were not at home at the time the representative called, a letter detailing the temporary road closures was left. The letter also advised them of Targa’s contact details to use, if the residents wished to object to the temporary closure of their respective roads. One objection has been received in the Raukawa area.
5.2 The temporary road closure notice related to the Targa Rally has been posted on the Council website and formal public notification was published in the Hawke’s Bay Today newspaper on Saturday 17 March 2018, with the period for objections closing at 4:00pm on Thursday 29 March 2018.
5.3 During the time that Club TARGA Incorporated carried out the residents visiting we received three objections. No further objections however have been received after the advertisement was published in the paper.
5.4 Details of Objections received were as follows:
Objection 1:
An anonymous e-mailed response from a resident on Middle Road saying that the rally is an inconvenience and they get no compensation for the disruption and it does not benefit them as residents.
Action taken:
Only an e-mail address was given. A response was sent to that email address requesting contact information so that further communication could be made in order for Council to respond to their issues and concerns.
No further communications were received from that person.
Objection 2:
An e-mail was received from Mr and Mrs Young of 563 Matapiro Road, concerned with limited access causing disruption to their day, especially as they had to go to and from sports games.
Action taken:
Club TARGA Incorporated (Peter Martin) have contacted Mr and Mrs Young and have agreed to ‘escort’ them to and from their property at prearranged times. They have provided them with a free phone contact number so that they can call Mr Martin to arrange marshal attendance to assist them with access to and from their property.
Mr and Mrs Young responded to TARGA’s reply appreciating the offer which has resolved their concerns, they have also exchanged contact details. They are therefore happy for the event to continue.
Objection 3:
An e-mail was received from Marek Plesner of 431 Apley Road opposed to the road being closed for a third time within 12 months. He is also concerned about the noise of the cars to residents and animals, the amount of time (3hrs) the road is closed during the day.
Action Taken:
Mr Plesner’s e-mail was forwarded to Club TARGA Incorporated (Peter Martin) so that the latter could discuss Mr Plesner’s concerns with him to try to minimise the impact of the road closure. Mr Martin did make contact with Mr Plesner.
Mr Plesner also contacted the Operations Engineer (Tim Bateman) and they had a long conversation about the proposed closure. Mr Plesner was not happy that his contact details and the nature of his objection had been passed onto TARGA.
It was explained to Mr Plesner that his details were given to TARGA so that they could try and help reach an agreed solution. It was also explained that as Mr Plesner had made an objection he was invited to a Temporary Road Closures Sub-committee hearing to address the full details of the proposal and he would have the opportunity to put forward his concerns.
Mr Bateman asked Mr Plesner to confirm if he wanted to pursue his ‘objection/ complaint’ so that it could be included in the report to trigger a hearing, he replied “he would have to think about it”. Mr Plesner emphasised that his e-mail was not an objection but a complaint.
Nothing further has been heard from Mr Plesner about this application.
5.5 Electronic copies of all the e-mail correspondence to / from the above noted parties have been saved into the Council’s records system, but have not been included as attachments to this report.
5.6 If the closures are approved final formal public notification will be published in the Hawke’s Bay Today newspaper on Saturday, 21 April 2018.

5.8 The applicant is advised that the Council does not accept any liability for damage of any kind caused to any person, vehicle, property or business that occurs within or outside the road corridor arising from the closure of the road corridor and any activities within it.
5.9 Emergency Services including NZ Police, St John Ambulance, Ministry of Transport (MoT), New Zealand Transport Agency (NZTA) and the Fire Service have all been informed and will be allowed emergency access at any time during the temporary road closures.
6.0 ASSESSMENT OF OPTIONS (INCLUDING FINANCIAL IMPLICATIONS)
6.1 The above temporary road closures will be undertaken in accordance with The Local Government Act 1974 Schedule 10, section 11 and section 11(e) which states:
“11. The council may, subject to such conditions as it thinks fit (including the imposition of a reasonable bond), and after consultation with the Police and the Ministry of Transport, close any road or part of a road to all traffic or any specified type of traffic (including pedestrian traffic).”
“(e) For a period or periods not exceeding in the aggregate 31 days in any year for any exhibition, fair, show, market, concert, film-making, race or other sporting event, or public function:
Provided that no road may be closed for any purpose specified in paragraph (e) of this clause if that closure would, in the opinion of the council, be likely to impede traffic unreasonably.”
6.2 By allowing the above temporary road closures the organisers can undertake their events in a safe and controlled environment with all risks minimised and managed.
6.3 If Club Targa Incorporated was to remove roads previously used in the last three years from their event it is not known what detrimental impact this would have on the entire rally.
6.4 It is anticipated that the current road bond scheme and inspection process will be appropriate to manage this risk and fund any remedial works that may be generated, should any damage to the surface of these roads and roadside infrastructure occur as a result of them being used for a rally event. In previous years this process has worked well with minimal to no damage incurred.
7.0 PREFERRED OPTION/S AND REASONS
7.1 Officers present the following three options to the Committee for discussion.
7.2 Option A: Approve the temporary road closures detailed above after considering the three submissions.
7.3 Option B: Do not approve the temporary road closures detailed above. This may impact on the holding of the event.
7.4 Option C: Approve only some of the temporary road closure detailed above. This may mean that the only temporary closures approved would be those of the roads that did not receive any submissions against their closure, being:
a. Taihape Road
b. Ohiti Road
c. Crownthorpe Settlement Road
d. Puketitiri Road
e. Glengarry Road
f. Tuki Tuki Road
g. Kahuranaki Road
h. Okaihau Road
i. Maraetotara Road
j. Raukawa Road
k. Whakapirau Road; and
l. Te Aute Road
7.5 The roads that were subject to a submission opposing its closure might be refused approval to be temporarily closed, being Matapiro Road, Middle Road and Apley Road.
8.0 PREFERRED OPTION/S AND REASONS
8.1 Option A is the recommended option. It recommends the Committee approve the temporary road closures detailed above, subject to conditions that will ensure public safety is maintained.
8.2 Given that there are no submissions opposing the closures for roads listed above (a through to l) and the objection for the Matapiro Road closure has been mitigated and that the objector from Middle Road failed to respond and that the objector from Apley Road declined to progress the objection, subject to the recommended conditions the activity can proceed and be undertaken in a safe and controlled environment, the risks associated with this closure can then be minimised and safely managed to Council’s satisfaction.

1. Ormond Road - from end of road (river end) to Evenden Road
2. Evenden Road - from Ormond Road to Raupare Road
3. Raupare Road - from Evenden Road to Trotter Road
4. Trotter Road - from Raupare Road to Evans Road
5. Evans Road - from Trotter Road to Twyford Road
6. Twyford Road - from Evans Road to Curtis Road
7. Curtis Road - the entire length
8. Hill Road - the entire length

2.0 BACKGROUND
2.1 The above event is being held by the following organisation: The Air New Zealand International Marathon where they are seeking approval to close the following roads within the Hastings District:
1. Ormond Road - from end of road (river end) to Evenden Road
2. Evenden Road - from Ormond Road to Raupare Road
3. Raupare Road - from Evenden Road to Trotter Road
4. Trotter Road - from Raupare Road to Evans Road
5. Evans Road - from Trotter Road to Twyford Road
6. Twyford Road - from Evans Road to Curtis Road
7. Curtis Road - the entire length
8. Hill Road - the entire length
2.2 This will be the first instance of these sections of road being temporarily closed during the 2018 calendar year. The above roads have been specifically chosen for their suitability for holding this particular event. The roads are in close proximity to local vineyards and also the limestone pathways which the event is largely being held on.
2.3 The temporary closure check list (Attachment 1) details the necessary items that the organiser need to submit as part of their application for the above proposed road closures. GIS maps showing the area of the temporary road closures are also attached – as Attachment 2: Ormond Road, Evenden Road, Raupare Road, Trotter Road, Evans Road, Twyford Road, Curtis Road and Hill Road.
2.4 At the time of writing this report Officers are not aware of any road works that will affect or impact the above temporary road closures.
3.0 CURRENT SITUATION
3.1 The temporary road closures will be managed in accordance with the New Zealand Transport Agency Code of Practice Temporary Traffic Management (CoPTTM).
3.2 A detailed Traffic Management Plan is to be submitted to the Hastings District Council and the Plan will be approved for implementation subject to the temporary road closure application being approved.

4.3 Option C: Approve only one, two, three, four, five, six or seven of the eight temporary road closures detailed above.
5.0 SIGNIFICANCE AND ENGAGEMENT
5.1 Organisers of the above event have been in contact with affected parties/residents and there are no issues regarding the above temporary road closures.
5.2 The Air New Zealand International Marathon organisers have been in contact with affected residents and have advised them, in a letter, of contact details if they (the residents) wish to object to the temporary road closures of the above detailed temporary road closures. The Air New Zealand International Marathon organisers have also supplied completed Resident Visiting forms to Council.
5.3 The temporary closure of the above roads has been posted on the Council website and formal public notification was published in the Hawke’s Bay Today newspaper on Saturday, 17 March 2018, with the period for submissions closing at 4:00pm, Thursday, 29 March 2018.
5.4 No submissions have been received by the closing date of Thursday, 29 March 2018.
5.5 Due to the type of event (a marathon) whereby only runners / walkers will be using the closed sections of road no road bond is required.
5.6 If the above temporary road closures are approved final formal notification will be published in the Hawke’s Bay Today newspaper on Saturday 21 April 2018.
5.7 The average daily traffic counts for the temporary road closures are listed in the table below:

5.8 As per the requirements of schedule 10, section 11, Emergency Services including Police, St John Ambulance, Ministry of Transport (MoT), New Zealand Transport Agency (NZTA) and the Fire Service have been informed and will be allowed emergency access at all times during the temporary road closures. Council has not received any submissions from either MoT, NZTA or the NZ Police.
6.0 HEALTH AND SAFETY
6.1 As per the requirements of the Health and Safety at Work Act 2015, the applicant is required to include a Health and Safety Plan with their temporary road closure application. Additionally, conditions drawing the applicant’s attention to their obligations have been provided in the recommendations.
7.0 ASSESSMENT OF OPTIONS (INCLUDING FINANCIAL IMPLICATIONS)

8.1 Option A is the preferred option. It recommends the Committee approve the temporary road closures detailed above, subject to conditions that will ensure public safety is maintained.
8.2 Given that there are no submissions in opposition to the closures and that subject to the recommended conditions the activity can proceed and be undertaken in a safe and controlled environment, the risks associated with this closure can then be minimised and safely managed to Council’s satisfaction.
