1.0 INTRODUCTION
1.1 This is a covering report relating to an application for resource consent to establish a site for the processing of extracted river gravels (Defined as ‘Mining’ in the Proposed Hastings District Plan) and to erect associated ancillary structures (RMA20180258) Russell Roads Limited.
1.2 This agenda can be viewed on the Council website and a reference hardcopy is held at the Ground Floor Reception, Council’s Civic Administration Building, Lyndon Road East, Hastings and at each of the district libraries (in Havelock North, Flaxmere and Hastings).
1.3 For ease of reference the recommendation from the attached Planner’s Report is also set out below, as part of this covering report.
2.0 RECOMMENDATIONS
A. That pursuant to Rule EM8 of the Proposed Hastings District Plan (As Amended by Decisions 15 September 2015) and Sections 104, 104B and 108 of the Resource Management Act 1991, resource consent as a Discretionary Activity is GRANTED to Russell Roads Limited to undertake the processing of gravel associated with gravel extraction activities (defined as ‘Mining’) on a site legally described as Lot 4 Deposited Plan 463659, CFR 614100 and physically located along the bank of the Ngaruroro River, near Maraekakaho.
B. That pursuant to Rule NH12 and Sections 104, 104B, 104D and 108 of the Resource Management Act 1991 resource consent as a Non-Complying Activity is GRANTED to Russell Roads Limited to erect permanent buildings within the River Hazard Overlay on a site legally described as Lot 4 Deposited Plan 463659, CFR 614100 and physically located along the bank of the Ngaruroro River, near Maraekakaho.
C. That pursuant to Section 348 of the Local Government Act 1974 the Hastings District Council approves the granting of a right of way over Part Lot 1 Deposited Plan 357840 and Lot 3 Deposited Plan 473957 (CFR 663412) in favour of the Hawke’s Bay Regional Council, on the alignment shown in the application (attached below as ‘Proposed Site and Access Route’) with a minimum width of 6 metres.
SUBJECT TO THE FOLLOWING CONDITIONS:
GENERAL
1. That unless otherwise altered by the consent conditions, the proposal shall proceed in accordance with the plans and information submitted in the application Resource Consent: RMA20120258, application received 25 June 2018, specifically:
a) Application (HDC Ref: 103419#0004 - #0008)
b) Further information provided (103419#0016, #0017, #0020, #0103)
2. That no more than three full time equivalent staff (excluding truck drivers) shall be onsite at any one time.
3. That no retail sales of gravel shall occur from the site.
4. The activity shall be carried out between the hours of 0700 to 1800 hours Monday to Friday and 0700 to 1530 hours on Saturday’s. No operations shall take place on Sunday’s or public holidays.
5. All processed aggregate stockpiles shall not exceed 6 metres in height and all aggregate awaiting processing shall not exceed 10 metres in height.
6. That no more than 1020 cubic metres of aggregate shall be processed per day.
CONSTRUCTION MANAGEMENT PLAN
7. Prior to the commencement of any activities allowed by this consent, the consent holder shall submit a Construction Management Plan (CMP) prepared by a suitably qualified and experienced person(s) that details the way in which construction works for the proposed access and any landscaping bund will be managed to ensure there will be no adverse effects beyond the site to the satisfaction of the Environmental Consents Manager, Hastings District Council (or nominee). The CMP shall, as a minimum, address the following:
a) Timing and staging of construction works;
b) Reporting and auditing;
c) Complaints handling and reporting procedure;
d) All measures that will be undertaken to mitigate potential construction noise effects to ensure compliance with the conditions of this consent;
e) Any other measures that will be undertaken to mitigate potential nuisance effects;
f) The contact details for the site manager;
g) Compliance with the provisions of the New Zealand Standard NZS 6803:1999 “Acoustics – Construction Noise.”
CONSTRUCTION NOISE
8. All construction work, being the development of the access road and the construction of any permanent noise control or landscaping bunds on the site, shall be designed and conducted to ensure that noise measured at the notional boundary of any dwelling or noise sensitive activity does not exceed the Typical Duration Limits Specified in NZS6803:1999.
9. All construction noise shall be measured in accordance with New Zealand Standard 6803:1999 “Acoustics – Construction Noise.”
10. All construction work shall be limited to the hours of 7:00am – 5:00pm Monday to Friday and 8:00am – 5:00pm Saturday (with no work on Sundays or public holidays).
SITE MANAGEMENT PLAN
11. A Site Management Plan (SMP) shall be prepared by suitably qualified professional/s, and shall be submitted to the satisfaction of the Council’s Environmental Consents Manager, (or nominee), Hastings District Council, prior to the commencement of any activities allowed by this consent. This plan shall be updated annually and provided to the Council on the each anniversary of this consent and shall detail how all the conditions of this consent shall be complied with, and shall also include (but is not restricted to) the following:
(i) All details of site layout, the location of aggregate and stockpiles, areas of hardstand, ancillary buildings, site access, and the internal and external transport routes.
(ii) Details of how conditions of this consent in respect of Hazardous Substances, Dust, Noise and Traffic Movements will be complied with.
(iii) The total volume of aggregate processed per annum for the previous year.
(iv) The annual update shall address how any complaints received in the previous year have been addressed.
OVERSPILL, DUST AND DEBRIS
12. That the consent holder shall submit a final Dust Management Plan to the satisfaction of Council's Environmental Consents Manager, Planning and Regulatory Services (or nominee) that sets out the measures necessary to ensure the prevention of dust nuisance on adjacent land owners or occupiers, and along the access route, prior to the commencement of any activities allowed by this consent. Measures shall include, but are not limited to, the following:
a) During dry windy periods the aggregate shall be moistened prior to processing and for transporting beyond the site.
b) The access roadway shall be kept free of overspill, dust and debris.
c) All aggregates transported from the site shall be covered or carried in a dampened state to prevent dust annoyance. In the event of mud or gravel being carried off the property and deposited on the public carriageway the consent holder will arrange for its removal as soon as is reasonably possible.
d) Should offensive or objectionable dust be observed beyond the processing site boundary the activities generating the dust must cease immediately and must not restart until such time as the dust nuisance has been remedied.
NOISE
13. The following noise limits shall not be exceeded at any point within the notional boundary of any noise sensitive activity:

14. Noise shall be measured in accordance with the requirements of NZS 6801:2008: Acoustics - Measurement of Environmental Sound and assessed in accordance with the requirements of NZS 6802:2008: Acoustics - Environmental Noise.
15. Tonal reverse alarms are prohibited on all vehicles that are permanently located on the site, including the loader, excavator and any other mobile plant.
16. No plant or machinery shall be operated on site that has a special audible characteristic as defined by NZS6802:2008 Acoustics - Environmental Noise.
17. Where stockpiling exists and where it can practicably be used to screen machinery, the consent holder shall take all practicable steps to utilise stock piles to reduce noise levels to neighbouring properties.
18. Within three months of the date this consent is granted the Consent Holder shall demonstrate to the Environmental Consents Manager, Hastings District Council via field measurement and assessment that the noise limits set out in Condition 13 are complied with at all times. Sound levels shall be measured and assessment completed by a suitably experienced acoustic expert acceptable to the Council. Measurement shall be in accordance with New Zealand Standard 6801:2008 Acoustics - Measurement of Environmental Sound, and assessment in accordance with New Zealand Standard 6802:2008 Acoustics - Environmental Noise. The requested Noise Monitoring Compliance Report shall be submitted to the Environmental Consents Manager, Hastings District Council within 2 weeks of completing the field measurements.
19. In the event of non-compliance with Condition 13 the applicant shall implement any appropriate noise control work within one week and measure the noise once this treatment is in place within 2 weeks. A copy of these measurements shall be provided to the Environmental Consents Manager (or nominee), Hastings District Council, within one week of the monitoring being undertaken.
LANDSCAPING & SCREENING
20. That the consent holder shall submit a landscape plan prepared by a suitably qualified and experienced person for the approval of the Environmental Consents Manager (or nominee), prior to the commencement of any activities allowed by this consent. The landscaping plan shall include planting specifications detailing the specific planting species, the number of plants provided, locations, heights/Pb sizes. Specifically, the landscaping plan shall provide for:
a) Compliance with the recommendations of the Landscape and Visual Impact Assessment undertaken by Sue Dick of Eastern Earth Landscape Architects, dated 5 June 2018, submitted with the application.
b) Use of the following tree species: Willow/Salix matsudana, or other non-invasive Salix spp, or Poplar/Populus nigra x euramericana 'Crows Nest'; or Tasmanian blackwood/Acacia melanoxylon.
c) The trees shall have a minimum height of 1.5 metres when planted and be maintained at a minimum height of 5 metres;
d) Methods used to ensure the successful establishment of the trees;
e) Provision for irrigation.
21. Prior to the commencement of any activities allowed by this consent the landscaping shall be planted and irrigation installed in accordance with the approved landscape plan required by Condition 20.
22. That in regard to Conditions 20 and 21 the required landscaping and screening shall be maintained for the duration of this consent to the satisfaction of the Environmental Consents Manager (or nominee), Hastings District Council.
Advice Note: “Maintained” means the ongoing replacement of any dangerous, dead or dying matter, the replacement of any plants that are lost or are otherwise defective and the general preservation of the landscaping to a healthy standard.
23. Prior to the commencement of any activities allowed by this consent the processing site shall be fenced off to prevent public access in order to create a secure area.
SITE ACCESS
24. A copy of the proposed easement across Pt Lot 1 DP 357840 and Lot 3 DP 473957 (CFR 663412) in favour of the Hawke’s Bay Regional Council shall be provided to the Environmental Consents Manager (or nominee), Hastings District Council, prior to the commencement of any activities allowed by this consent.
25. Engineering plans detailing the construction of the State Highway 50 entrances and internal access in accordance with the requirements of the New Zealand Transport Agency and the Hastings District Council Engineering Code of Practice 2011 and Proposed Hastings District Plan, shall be submitted to the Environmental Consents Manager (or nominee), Hastings District Council, prior to construction.
26. The access route from State Highway 50 to the processing site shall have a chip seal road surface, or similar, be constructed in accordance with the HDC approved design, and be maintained to ensure an uneven road surface does not develop. All internal roads shall be maintained to a high standard so that pot holes and an uneven road surface do not cause unnecessary body and tray rattle on vehicles.
27. Construction of the State Highway 50 vehicle crossing, right turning lane and internal access shall be completed in accordance with the approved design(s) and to the satisfaction of the Environmental Consents Manager (or nominee), Hastings District Council, prior to the commencement of any activities allowed by this consent.
28. The consent holder shall submit a Statement of Professional Opinion from a suitably qualified and registered professional engineer that the construction works for the access and internal roads have been completed in accordance with the approved plans, prior to the commencement of any activities allowed by this consent.
29. All vehicle entranceway construction work shall be undertaken by a contractor who has been pre-approved by the New Zealand Transport Agency to work in the boundaries of the legal road.
TRAFFIC AND TRANSPORT
30. That a Traffic Management Plan prepared by a suitably qualified professional be submitted, for the approval of the Environmental Consents Manager, Hastings District Council prior to the commencement of the activity and shall include, but is not limited to, the following:
a) Specific details relating to vehicle movements, and community safety;
b) The number and timing of truck movements throughout the day;
c) A requirement that all vehicles shall be securely covered or loads carried in a dampened state to prevent loss of load;
d) A requirement that all vehicles shall have their headlights turned on throughout operation to provide increased awareness and improved visibility;
e) A direction to drivers that every truck driver will be briefed on the approved Traffic Management Plan, and driver protocol, and details of how this will be achieved;
f) A requirement that a speed limit of 20km/hr shall be implemented on site.
31. The Consent Holder shall ensure all on site activities authorised by this consent are carried out in accordance with the approved Traffic Management Plan for this site.
32. That the number of heavy vehicle movements shall not exceed a peak daily rate of 85 or a peak hourly rate of 18 per hour. (Note: a vehicle movement includes the arrival or departure of the vehicle).
33. That once the access route from State Highway 50 to the processing site is operational all vehicle traffic shall use this access. No access to the site from the unformed legal road off Kereru Road shall be allowed.
HAZARDOUS SUBSTANCES
34. The consent holder shall ensure all plant and equipment is stored on a hardstand area, bunded to prevent contamination by accidental spillage or leakage of fuels, oils or other contaminants.
35. The consent holder shall provide anti-contaminant traps to trap any spillage or leakage of contaminants, the content of which shall be removed from site for disposal as necessary.
36. Any hazardous substance stored on-site shall be stored in a locked and secured storage facility bunded to prevent contamination by spillage or leakage of fuels, oils or other contaminants.
END OF OPERATIONS
37. Within 6 months of the activities authorised by this consent ceasing or the expiry of this consent the consent holder shall ensure any noise control screening is removed and all parts of the processing site are rehabilitated to the satisfaction of the Environmental Consents Manager (or nominee), Hastings District Council.
REVIEW CONDITION
38. Pursuant to Section 128 of the Resource Management Act 1991 the Council may review any condition(s) of this consent at any time or upon receipt of a justified complaint, to ensure the effectiveness of conditions imposed in addressing adverse effects on the environment that might otherwise arise from the exercise of this consent.
MONITORING
39. That a monitoring deposit of $220 (including GST) shall be payable to cover the reasonable costs of monitoring compliance with the above conditions in accordance with Council's schedule of charges. In the event of non-compliance being detected by monitoring or justified complaint and/or the costs of monitoring consent exceeding the deposit, the costs to Council of any additional monitoring shall be paid by the consent holder in accordance with the Council's advertised schedule of fees.
40. That all costs associated with complying with any or all conditions of this consent shall be borne by the consent holder.
WITH THE REASONS FOR THIS RECOMMENDATION BEING:
1. The GENERAL conditions ensure that the development proceeds in accordance with the plans and information submitted and assessed.
2. The CONSTRUCTION MANAGEMENT PLAN condition ensures that appropriate construction methods are undertaken during the construction of the proposal.
3. The CONSTRUCTION NOISE conditions ensure that the proposal complies with the New Zealand Standard for Construction Noise (NZS6803:1999).
4. The SITE MANAGEMENT PLAN condition ensures that the activities onsite are in accordance with best practice and the conditions of this consent.
5. The OVERSPILL, DUST AND DEBRIS conditions ensure that any adverse effects resulting from the operation of the proposal do not adversely affect adjacent properties.
6. The NOISE conditions ensure that all noise generated by the proposal is appropriately designed to ensure that the noise limits for the Plains Zone are complied with.
7. The LANDSCAPING & SCREENING conditions ensure that the proposal will be adequately landscaped and screened from adjacent properties and road users so that the amenity of the area is maintained.
8. The SITE ACCESS and TRAFFIC AND TRANSPORT conditions ensure that safe and efficient access to the districts roading network is provided.
9. The HAZADOUS SUBSTANCES conditions ensure that any hazardous substances are appropriately located to avoid adverse effects on the environment.
10. The END OF OPERATION condition ensures that the site is rehabilitated when the activity ceases.
11. The REVIEW CONDITION ensures the conditions of consent can be reviewed to ensure any adverse effects since the granting of consent can be addressed.
12. The MONITORING conditions ensure that the consent holder pays the actual and reasonable charges associated with monitoring the consent and that all conditions of consent are monitored for compliance.
13. The ADVERSE EFFECTS of this proposal are less than minor, in that:
Visual Amenity
· Landscaping will occur in front of the site thereby helping to screen and maintain the amenity of the area. Any adverse visual effects are likely to be less than minor as confirmed by an expert landscape architect;
· That while the character of the site will be affected from that which presently exists, visual effects can be mitigated by the imposition of appropriate conditions;
· That due to the contrast between the processing site and surrounding vegetated areas, the processing site will be noticeable in the landscape when seen from the houses on the hill to the south. Due to the vastness of the views of the river plains and the relatively small scale of the processing site and with the proposed screen planting, it is considered that the site will have a less than minor adverse effects on these views when seen from these locations;
· It is acknowledged that the proposed screen planting won't totally screen the site from the viewing locations on the upper parts of the hill due to the viewing angle. However, the planting will reduce the visual dominance in the landscape;
· The machinery will not be prominent in the landscape amongst the gravel and given the height of the stockpiles at up to 10 metres much of the machinery will be well screened from the adjacent dwellings on the hillside opposite the site.
Noise
· Noise from the proposal as assessed by suitably qualified acoustic experts has been shown to comply with the Proposed District Plan noise limits at the notional boundary of all noise sensitive activities;
· Acoustic advice confirms that noise effects resulting from the increase in heavy traffic movements on SH 50 is negligible;
· All activities occurring on the site are confined to normal daytime hours and there will not be any effects on sleep disturbance given that all operations will be finished by 6pm weekdays and 3:30pm on Saturday;
· Hours of operation of the activity have been limited to 7am to 6pm Monday to Friday and 7:00am to 3:30pm Saturday;
· The acoustic peer review of the applicant’s noise assessment by Hegley Acoustics has confirmed that the proposal can comply with the Proposed District Plans noise limits at the notional boundary of all noise sensitive activities in the vicinity and reduced noise limits have been recommended given the nature of the activity.
Traffic
· In relation to traffic movements there is no restriction on the number of traffic movements for rural sites throughout the District. Given the site is accessed from a State Highway the Hastings District Council is not the road controlling authority in this instance as the State Highway is the responsibility of the NZTA. As the NZTA have provided their written approval to the proposal subject to upgrading the intersection to their satisfaction, no adverse effects on the road network are anticipated;
· While it is acknowledged that there is the potential for conflict given the number of heavy traffic movements proposed which will be approximately 18 per hour on the busiest day between 7am and 6pm, the organisation responsible for the State Highway and access to and from it (being the New Zealand Transport Agency) has provided their written approval to the proposal, subject to the upgrading of the vehicle crossing and the addition of a right turn lane, meaning that any adverse effects on the State Highway must be disregarded;
· Safe and efficient access can be provided subject to the upgrading of the vehicle access to NZTA requirements;
· Sufficient onsite parking and loading can be provided;
· The access road from SH50 to the proposed processing site will be sealed and will be required to be maintained to a high standard to reduce potential noise from heavy vehicle movements.
Dust
· Appropriate conditions in relation to dust and the adoption of a dust management plan will ensure that any off site effects from dust can be mitigated.
Natural Hazards
· Based on advice from the Hawke’s Bay Regional Council it can be concluded that there are no adverse effects of the proposal in relation to natural hazards, and in relation to flooding, the proposed activity poses little risk.
Reverse Sensitivity
· Gravel extraction and processing is not a particularly ‘sensitive’ land use, and is unlikely to restrict the ability of adjoining land owners to carry out legitimate/lawful activities.
River Access
· The proposal is located entirely within a site owned by the Hawke’s Bay Regional Council and no change to the existing river access will result from the proposal.
14. The proposal is consistent with the OBJECTIVES, POLICIES and OTHER PROVISIONS of the Proposed Hastings District Plan, in that:
· The adverse effects on the environment can be mitigated by appropriate conditions and will be no more than minor;
· The proposal will support activities that utilise the Heretaunga Plains resource in a sustainable manner, while having a minor effect on the life-supporting capacity on the soil resource;
· The scale and intensity of the activity does not restrict the sustainable management of the wider Rural Zone soil resource;
· Safe and efficient access to and from the site can be provided;
· The proposal will not increase the risk of natural hazards;
· The amenity of Rural Zone can be maintained.
15. In terms of Section 104(1)(c) the proposal is not contrary to the overall policy directions for the Rural Zone or the District Wide Earthworks and Mining Section and it is unlikely to pose a ‘significant challenge’ to the key Objectives and Policies of the Proposed District Plan.
16. In terms of Section 104D in relation to Natural Hazards the effects on the environment will be no more than minor and the proposal is not contrary to the key objectives and policies of the Proposed Hastings District Plan. The proposal can therefore qualify for consideration under Section 104D, and pursuant to Section 104(1), and subject to Part II of the Act.
17. Overall the proposal promotes sustainable management as required by Part II of the Resource Management Act 1991 in that:
· It will result in acceptable adverse effects on landscape, rural character and amenity effects;
· Any potential adverse effects can be avoided, remedied or mitigated by conditions of consent.
ADVICE NOTES:
1. To avoid doubt, except as otherwise allowed by this resource consent, all landuses must comply with all remaining standards and terms of the relevant Hastings District Plan. The proposal must also comply with the Building Act 2004, Engineering Code of Practice and Hawke’s Bay Regional Plans. All necessary consents and permits shall be obtained prior to development.
2. Under Section 125 of the Resource Management Act 1991 a resource consent will lapse if not given effect to within 5 years of the date the consent was granted, unless an extension is granted under Section 125(1A).
