The Road Closure Subcommittee is responsible for assisting Council by:
· Reviewing, considering submissions and deciding applications for temporary closure of roads.

Environmental Manager Consents
Quorum – 2 members of whom one shall be the Chairman or the Deputy Chairman.
DELEGATED POWERS
All the Council’s powers and functions in respect to temporary prohibition of traffic under Section 342(1)(b) and clause 11(e) of Schedule 10 of the Local Government Act 1974.
The Subcommittee reports to the Works and Services Committee.

2. Conflict of Interest
Members need to be vigilant to stand aside from decision-making when a conflict arises between their role as a Member of the Council and any private or other external interest they might have. This note is provided as a reminder to Members to scan the agenda and assess their own private interests and identify where they may have a pecuniary or other conflict of interest, or where there may be perceptions of conflict of interest.
If a Member feels they do have a conflict of interest, they should publicly declare that at the start of the relevant item of business and withdraw from participating in the meeting. 1.0 SUMMARY
1.1 The purpose of this report is to obtain a decision from the Committee on the following proposed temporary road closures requested by Club Targa Incorporated:
1.2 Targa Rally
Saturday, 18 May 2019 1:05pm and 6:05pm
· Taihape Road from Kuripapango Bridge (HDC Boundary) to 300m prior to the intersection with River Road and Glenross Road
Sunday, 19 May 2019 8:00am and 12:00noon
· Hedgeley Road from rapid number 24 to Seafield Road
· Seafield Road from Hedgeley Road to Puketitiri Road
· Puketitiri Road from Seafield Road to Glengarry Road
· Glengarry Road from Puketitiri Road to 300m prior to the intersection with SH5
· Crownthorpe Settlement Road 300m from the intersection with Taihape Road to Matapiro Road

1.3 These requests arise from the need to inform and gain Hastings District Council (‘the Council’) approval in order to comply with the legal process to temporarily closing the above roads.
1.4 The Council is required to give effect to the purpose of local government as prescribed by Section 10 of the Local Government Act 2002. That purpose is to meet the current and future needs of communities for good quality local infrastructure, local public services, and performance of regulatory functions in a way that is most cost–effective for households and businesses. Good quality means infrastructure, services and performance that are efficient and effective and appropriate to present and anticipated future circumstances.
1.5 The objective of this decision relevant to the purpose of Local Government is to provide for good quality local public services by allowing the proposed events to take place in a controlled environment with the temporary road closure provisions providing safety measures for residents and road users in the particular areas while the activities are being undertaken
1.6 This report concludes by recommending that, subject to conditions, the above temporary road closures be approved.
2.0 BACKGROUND
2.1 The above event is being undertaken by Club Targa Incorporated requiring the temporary road closure of Taihape Road, Hedgeley Road, Seafield Road, Puketitiri Road, Glengarry Road, Crownthorpe Settlement Road, Matapiro Road, Ohiti Road, Maraetotara Road, Okaihau Road, Kahuranaki Road, Te Onepu Road, Argyll Road, Te Aute Trust Road, Middle Road and Te Aute Road. This will be the first temporary closure of these roads during the 2019 calendar year except Te Aute Road which will be temporarily closed for a second time if this application is granted. The roads have been chosen specifically for this event due to their length and suitability for this type of event.
2.2 The temporary closure check list (Attachment 1) details the necessary items that the organiser needs to submit as part of their application for the above proposed temporary road closures. GIS maps showing the area of the temporary road closures are also attached – as part of Attachment 1: Taihape Road, Hedgeley Road, Seafield Road, Puketitiri Road, Glengarry Road, Crownthorpe Settlement Road, Matapiro Road, Ohiti Road, Maraetotara Road, Okaihau Road, Kahuranaki Road, Te Onepu Road, Argyll Road, Te Aute Trust Road, Middle Road and Te Aute Road.
2.3 At the time of writing this report Officers are not aware of any road works that will affect or impact the above temporary road closures.
3.0 CURRENT SITUATION
3.1 The temporary road closures will be managed in accordance with the New Zealand Transport Agency Code of Practice Temporary Traffic Management (CoPTTM).
3.2 A detailed Traffic Management Plan is to be submitted to the Hastings District Council and the Plan will be approved for implementation subject to the temporary road closure application being approved.
4.0 OPTIONS
4.1 Option A: Approve the temporary road closures detailed above.
4.2 Option B: Do not approve the temporary road closures detailed above.
4.3 Option C: Approve only one, two, three, four, five, six, seven, eight, nine, ten, eleven, twelve, thirteen, fourteen or fifteen of the sixteen temporary road closures detailed above.
5.0 SIGNIFICANCE AND ENGAGEMENT
5.1 Club Targa Incorporated representatives undertook a resident consultation process. If residents were not at home at the time the representative called, a letter detailing the temporary road closures was left. The letter also advised them of Targa’s contact details to use, if the residents wished to submit an objection to the temporary closure of their respective roads. No submissions have been received.
5.2 The temporary road closure notice related to the Targa Rally has been posted on the Council website and formal public notification was published in the Hawke’s Bay Today newspaper on Saturday, 16 February 2019, with the period for objections closing at 4:00pm, Monday, 4 March 2019.
5.3 No submissions had been received by the closing date of Monday, 4 March 2019.
5.4 If the closures are approved final formal public notification will be published in the Hawke’s Bay Today newspaper on Friday, 17 May 2019.
5.5 The following traffic counts (vehicles per day) are provided for the roads that are to be closed as part of the Targa Rally:

5.6 As per the requirements of schedule 10, section 11 of the Local Government Act, Emergency Services including NZ Police, St John Ambulance, Ministry of Transport (MoT), New Zealand Transport Agency (NZTA) and the Fire Service have been informed and will be allowed emergency access at all times during the temporary road closure. Council has not received any submissions from emergency services, MoT or NZTA. Additionally, Middle Road and Te Aute Trust Road are the official detour route that NZTA make use of if SH2 needs to be closed during an emergency event. If an event did occur this would result in the Te Aute Trust Road and Middle Road sections of the Targa Rally being cancelled.
5.7 The Council will not accept any liability for damage of any kind caused to any person, vehicles, property or business that occurs within or outside the road corridor arising from the closure of the road corridor and any activities within it.
6.0 HEALTH AND SAFETY
6.1 As per the requirements of the Health and Safety at Work Act 2015, the applicant is required to include a Health and Safety Plan with their temporary road closure application. Additionally, conditions drawing the applicant’s attention to their obligations, including compliance with the Health and Safety Plan, have been provided in the recommendations.
7.0 ASSESSMENT OF OPTIONS (INCLUDING FINANCIAL IMPLICATIONS)
7.1 The above temporary road closures will be undertaken in accordance with The Local Government Act 1974 Schedule 10, section 11 and section 11(e) which states:
“11. The council may, subject to such conditions as it thinks fit (including the imposition of a reasonable bond), and after consultation with the Police and the Ministry of Transport, close any road or part of a road to all traffic or any specified type of traffic (including pedestrian traffic).”
“(e) For a period or periods not exceeding in the aggregate 31 days in any year for any exhibition, fair, show, market, concert, film-making, race or other sporting event, or public function:
Provided that no road may be closed for any purpose specified in paragraph (e) of this clause if that closure would, in the opinion of the council, be likely to impede traffic unreasonably.”
7.2 By allowing the above temporary road closures the organisers can undertake their events in a safe and controlled environment with all risks minimised and managed.
7.3 It is anticipated that the current road bond scheme and inspection process will be appropriate to manage this risk and fund any remedial works that may be generated, should any damage to the surface of these roads and roadside infrastructure occur as a result of them being used for a rally event. In previous years this process has worked well with minimal to no damage incurred.
8.0 PREFERRED OPTION/S AND REASONS
8.1 Option A is the recommended option. It recommends the Subcommittee approve the temporary road closures detailed above, subject to conditions that will ensure public safety is maintained.
8.2 Given that there are no submissions in opposition to the closures and subject to the recommended conditions the activity can proceed and be undertaken in a safe and controlled environment. The risks associated with this closure can then be minimised and safely managed to Council’s satisfaction.

· Beatson Road from Windsor Avenue to the end of Beatson Road – 5:00am – 9:00am
· Crosses Road from St Georges Road to Napier Road – 8:00am – 9:00am
· Karanema Drive between Napier Road and Te Mata Road – 8:00am – 9:15am
· River Road (Havelock North) the final kilometre of River Road with resident access only – 8:00am – 11:00am
· Moore Road from Tuki Tuki Road to the end of Moore Road – 6:00am – 8:00am
· Haumoana Road from Beach Road to the end of Haumoana Road with resident access only – 6:00am – 2:00pm
· Grove Road (Haumoana) the entire length – 6:00am – 2:00pm
· Grange Road (Haumoana) the entire length with resident access only – 6:00am – 2:00pm
· Clifton Road between 41 Clifton Road and 252 Clifton Road (Te Awanga Estate entrance) with resident access only – 6:00am – 3:00pm

2.2 This will be the first instance of these sections of road being temporarily closed during the 2019 calendar year. The above roads have been specifically chosen for their suitability for holding this particular type of event. The roads are in close proximity to local vineyards and also the limestone pathways which the event is largely being held on.
2.3 The temporary closure check list (Attachment 1) details the necessary items that the organiser needs to submit as part of their application for the above proposed road closures. GIS maps showing the area of the temporary road closures are also attached – as part of Attachment 1. These being: Beatson Road, Crosses Road, Karanema Drive, River Road (Havelock North), Moore Road, Haumoana Road, Grove Road (Haumoana), Grange Road (Haumoana) and Clifton Road.
2.4 At the time of writing this report Officers are not aware of any road works that will affect or impact the above temporary road closures.

5.1 Organisers of the above event have been in contact with affected parties/residents and there are no issues regarding the above temporary road closures.
5.2 The Air New Zealand International Marathon organisers have been in contact with affected residents and, in a letter, have advised them of contact details if they (the residents) wish to object to the temporary closure of the above listed roads. The Air New Zealand International Marathon organisers have also supplied completed Resident Visiting forms to Council.
5.3 The temporary closure of the above roads has been posted on the Council website and formal public notification was published in the Hawke’s Bay Today newspaper on Saturday, 2 March 2019, with the period for submissions closing at 4:00pm, Monday, 18 March 2019.
5.4 No submissions had been received by the closing date of Monday, 18 March 2019.
5.5 Due to the type of event (a marathon) whereby only runners / walkers will be using the closed sections of road no road bond is required.
5.6 If the above temporary road closures are approved final formal notification will be published in the Hawke’s Bay Today newspaper on Friday, 17 May 2019.
5.7 The average daily traffic counts for the temporary road closures are listed in the table below:
