Conflict of Interest – He Ngākau Kōnatunatu

Members need to be vigilant to stand aside from decision-making when a conflict arises between their role as a Member of the Council and any private or other external interest they might have.  This note is provided as a reminder to Members to scan the agenda and assess their own private interests and identify where they may have a pecuniary or other conflict of interest, or where there may be perceptions of conflict of interest. 

If a Member feels they do have a conflict of interest, they should publicly declare that at the start of the relevant item of business and withdraw from participating in the meeting.  If a Member thinks they may have a conflict of interest, they can seek advice from the General Counsel or the Manager: Democracy and Governance (preferably before the meeting). 

It is noted that while Members can seek advice and discuss these matters, the final decision as to whether a conflict exists rests with the member.

State of the Environment Report 2015-2019

        

1.0    Executive Summary – Te Kaupapa Me Te Whakarāpopototanga

1.1       The purpose of this report is for Council to receive the ‘State of the Environment Report 2015-2019’ (The Report) with recommended changes as a result of the District Planning and Bylaws Subcommittee meeting held on the 22nd September 2021.

1.2       The Council is required to give effect to the purpose of local government as set out in section 10 of the Local Government Act 2002. That purpose is to enable democratic local decision-making and action by and on behalf of communities, and to promote the social, economic, environmental, and cultural wellbeing of communities in the present and for the future.

1.3       The effect of this decision relevant to the purpose of Local Government is that through monitoring of the environment Council can help ensure that local infrastructure, public services, and the performance of regulatory functions, are appropriate to the present and future needs of Hastings District.

1.4       The Report addresses Council’s obligation under Section 35 of the Resource Management Act to monitor the state of the environment of its district and to make available to the public a review of the results of its monitoring. The purpose as set out in the Act is to enable the public to be better informed of the duties, powers and functions of Council and to enable the public to participate effectively under the Act.   This is the third edition of The Report.

1.5       While the Report is a statutory requirement, it is a very useful documentary resource for signalling where policy amendments may be needed as a result of evolving or changing trends in the environment over time.  In 2021 The Report has been instrumental in informing the completion of The Eco District Strategy and identifying several potential issues within the Hastings District Plan.

1.6       The Report also contributes to achieving the goals set in the 2021-2031 Long Term Plan under the Environmental, Cultural, Social and Economic Wellbeing’s.

1.7       This report concludes by recommending that The Report is adopted by Council and that The Report is released for public viewing.

 

2.0    Recommendations - Ngā Tūtohunga

A)        That Council receive the report titled State of the Environment Report 2015-2019 (The Report) dated 14 December 2021.

B)        That Council adopt The Report.

C)        That The Report is released for public viewing.

D)        Council notes that The Report will be presented to the Rural Community Board and the Heretaunga Takoto Noa Māori Standing Committee for information purposes.

 

 

3.0    Background – Te Horopaki

3.1       This is the third Report completed by Council.  The second Report was completed and received by Council in November 2015.

3.2       Council has previously committed to reviewing The Report every 3 to 5 years.

3.3       The Report has been refined in the current edition to focus on Council’s functions. Previous Reports have included some indicators outside of Council’s control or influence.  

 

4.0    Discussion – Te Matapakitanga

4.1       The purpose of this report is for the Council to adopt the State of the Environment Report 2015-2019. A copy of The Report is attached as (Attachment 1).

4.2       Below is a summary of the changes made as a result of feedback from the District Planning and Bylaws Subcommittee.      

 

Mana Whenua Customary Environmental Values

This is more detailed and has been moved to the front of the document. On advice from the Pou Ahurea team, the section on Tangata Whenua was replaced with the section on Mana Whenua Customary Environmental Values.

Air and Water Sustainability

Removed air and water indicators and data as this is reported by Hawke’s Bay Regional Council (HBRC).

Removed indicators AQ1, AQ2, WQ1, WQ2 and WQ3 as this is relevant to HBRC.

Amenity, Character, and Heritage Management

Removed coastal indicators and data as this is reported by HBRC.

Removed indicators CA3, CA4 as they are reported by HBRC.

Removed the case study related to the introduction of the City Assist Team as it is now a permanent function of Council.

Sustainable Infrastructure

Electricity consumption: Removed indicators E1, E2 and data related to energy use as this is not a function of Council.

Removed indicators T1, T2, T3, T4, T5, T6, T7 relating to modes of transport.

Hazard Management

Remove case study for rural recycling as this has been implemented by Council.

Sustainable Waste Management

This resource indicator remains steady with only small fluctuations as detailed in The Report.

Fit with purpose of Local Government - E noho hāngai pū ai ki te Rangatōpū-ā-Rohe

The Council is required to give effect to the purpose of local government as set out in section 10 of the Local Government Act 2002. That purpose is to enable democratic local decision-making and action by (and on behalf of) communities, and to promote the social, economic, environmental, and cultural wellbeing of communities in the present and for the future.

The Report is relevant to the sustainable management of our physical and natural resources. Council has a duty to report on its performance as part of Section 35 (2) (a) of the Resource Management Act.

Financial considerations - Ngā Whakaarohanga Ahumoni

The Report is budgeted for under the Environmental Policy Work Programme.

Significance and Engagement - Te Hiranga me te Tūhonotanga

This Report has been assessed under the Council's Significance and Engagement Policy as being of low significance.
